Agreement between User and My Cool City

Welcome to My Cool City (the “Platform”). The Platform consists of web pages and mobile applications operated by My Cool City Inc. (“My Cool City”), offered to you conditioned on your acceptance, without modification, of the terms, conditions, and notices contained herein (the “Terms”). Your use of any My Cool City website or application constitutes your agreement to all such Terms. Please read them carefully.

My Cool City is a mobile and web-based platform that enables users to discover, explore, and connect with local service providers through publicly visible posts and business profiles.

IMPORTANT NOTICE:

THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY.

Privacy

2. Eligibility

Minimum Age:You must be at least 18 years old to use the Platform.

Service Providers: You (and your business, where applicable) must comply with local laws, including licenses and insurance if required.

3. Electronic Communications

By visiting mycoolcity.app, using the mobile app, or communicating via email or SMS, you consent to receive electronic communications. These satisfy any legal requirement that such communications be in writing.

You may opt out of SMS communications by replying STOP to any message.

When using features like calling or WhatsApp through the Platform, your phone number may be shared with the other party to enable direct communication.

4. Account Responsibility

You are responsible for maintaining your account’s security. You may delete your account at any time by emailing [[email protected]] with the subject “ACCOUNT DELETION REQUEST” and providing your full name, phone number, and the email used to create the account.

5. Children Under Thirteen

My Cool City does not knowingly collect personal information from children under 13.

6. Links to Third Parties

The Platform may include links to third-party websites. My Cool City is not responsible for their content, services, or privacy practices.

7. Intellectual Property

All content, including text, images, and code, is owned by My Cool City or its licensors. You may not copy, reproduce, distribute, or create derivative works without permission.

8. Communication Features

You agree to use message boards, chat areas, and other communication tools respectfully and lawfully. We may monitor or remove content at our discretion.

Do not upload inappropriate content, advertisements, viruses, or copyrighted materials you do not own.

9. Content You Provide

You retain ownership of content you upload (e.g. images, service descriptions), but you grant My Cool City permission to use it to operate the Platform, promote your business, and provide related features.

10. Third-Party Integrations

If you link your account with third-party services (like Facebook or Google), you agree to share necessary information according to their privacy settings.

11. International Users

The service is controlled and operated from the United States. If you access it from outside the U.S., you are responsible for complying with your local laws.

12. Indemnification

You agree to indemnify and hold harmless My Cool City from any claims, damages, or legal costs arising from your use of the Platform or interactions with other users.

13. Arbitration and Class Action Waiver

All disputes will be resolved through binding individual arbitration under the Federal Arbitration Act. Class actions are not allowed.

To opt out, email [[email protected]] within 30 days of accepting the Terms with the subject “ARBITRATION AND CLASS ACTION WAIVER” and your full name, phone number, and registered email.

14. Liability Disclaimer

You use My Cool City at your own risk. We do not verify the services offered on the Platform. We do not guarantee the quality, availability, or outcome of any services provided by businesses listed.

All interactions with other users are your sole responsibility. My Cool City simply connects users with service providers and is not involved in any transaction.

15. No Endorsement

My Cool City does not endorse, review, or validate any user or business listed on the Platform. We do not guarantee the accuracy, reliability, or legality of their services or claims.

16. Jurisdiction and Governing Law

These Terms are governed by the laws of the State of Florida, USA. All disputes not subject to arbitration will be resolved in the courts of Florida.

17. Changes to Terms

We may modify these Terms at any time. The current version will always be available at [mycoolcity.app](https://mycoolcity.app). Continued use of the Platform constitutes acceptance of any changes.
